Enclosed for your records is a copy of an as-filed provisional patent application
that we filed with the U.S. Patent and Trademark Office (USPTO) on December 19,
2008. We filed the application via electronically, thereby entitling the application to a
filing date of December 19, 2008 and has been assigned serial number 61/139,198.
 
You are now privileged to mark physical embodiments of the invention and any
literature or other information regarding the invention “PATENT PENDING”, and we
recommend doing so. However, please keep in mind that we filed this application as a
provisional application. A provisional application is not examined for patentability by the
Patent Office, and does not mature into a patent. However, a provisional application
does preserve the applicant’s right to claim “priority” to the provisional filing date in a
regular (i.e., non-provisional) U.S. patent application filed within one year of the
provisional filing date.
The international Patent Cooperation Treaty (PCT) and most foreign countries
also allow a priority claim to the provisional filing date in international and/or foreign
national patent applications filed within one year of the provisional filing date. In this
case, any regular U.S., PCT or non-PCT foreign patent applications must be filed on
or before December 19, 2009, in order to claim priority benefit to the provisional filing
date. We will enter this date in our docketing system and send you periodic reminders,
and recommend that you also calendar this deadline.
BEST MODE AND ENABLING DESCRIPTION
A provisional patent application entitles the applicant to claim the benefit of the
provisional filing date only to the extent that the claims of a later-filed regular application
are supported by the disclosure of the provisional application. That is, the provisional
application must describe the invention sought to be claimed in the later-filed regular
